1. Nature of service
Frederic James is a private brokerage and transaction management service representing buyers and sellers of exceptional vehicles. We are not a dealership, a marketplace, or an inventory-led business. All representations, opportunities and auctions are conducted under mandate.
2. Eligibility
Access to the Deal Room, bidder approval and confidential opportunities is by invitation and subject to identity verification, source-of-funds checks and acceptance of our engagement terms. We reserve the right to refuse or withdraw access at our absolute discretion.
3. Opportunities and descriptions
Vehicle descriptions, history, guide prices and condition reports are prepared in good faith from information supplied by vendors and independent inspections. They are not warranties. Clients are expected to undertake their own inspection and due diligence prior to commitment.
4. Auctions
Private and sealed auctions are conducted under mandate from the vendor. Bids are binding once submitted by an approved bidder. Reserve prices, buyer's premium, settlement timeframes and collection arrangements are confirmed in writing for each lot before bidding opens.
5. Deal Room
The Deal Room is provided as a secure environment to manage documentation, milestones, communication and transaction progress. Information shared within the Deal Room is confidential between the parties to that transaction and Frederic James.
6. Fees
Brokerage, advisory and transaction fees are set out in the individual engagement letter agreed with the client. No fees are charged for general enquiries.
7. Liability
To the maximum extent permitted by law, Frederic James shall not be liable for indirect or consequential loss arising from the use of the platform. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under English law.
8. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute, save where mandatory consumer protection rules in your country of residence provide otherwise.
